Most of the songs featured in his videos are from the seventies and eighties, so I guess it could be argued that having one of those songs featured in a Beato video might just rekindle some interest in it, or the band that originally performed it.

tl;dw- He's hired a lawyer full time because in 9 years he estimates he's had about 4000 copyright claims against him. And every single time it's gone to court he has won.

Ed plays guitar. He doesn't have any background in law, and he was 100% unambiguously flat out wrong about monetization automatically disqualifying fair use. But, you think he isn't just a keyboard warrior with an axe to grind? It's pretty obvious he has strong feelings that are driving what he chooses to see and believe no matter the evidence to the contrary.

I am no one's sock puppet other than I support the ability for content creators to make money off their work. ALL content creators. I don't put musicians above or below photographers, videographers, YouTubers etc. and I definitely don't support the big record labels who have been screwing over everyone from musicians to YouTubers to consumers. Sorry.

Among other things I do play guitar. And yes I have strong feelings about anything making money off some one else’s IP.
However I have no issues with folks raking in money.

But I admit the fanboism surrounded fear or yourtubers that has folks put on on blinders.

And again show me where I’m wrong about monetisation and fair use.
 
I’ve known you since ‘05, man, I’m aware of what you do for work. Not sure how much of that work relates to this specific thread, though.
I’ve had a publishing company small as it maybe for 3 decades.

But the bigger point no on has brought up is this, no one give a fuck what any one uses until they make real money and that’s when the fun starts.

So if Rick Beato used 10 seconds of one of your published songs in a vid, you’d be more angry about that than Spotify playing your full songs at the highest quality for pennies?
 
One of the youtube copyright oddities I don't get is when someone uses 10-15 seconds of a guitar riff while demoing a piece of gear and then has to hand over all of the money from the video when they get a copyright strike.

If the video is say an hr long and the portion of the video under question under 30 seconds then why is the entity who is claiming copyright able to help themselves to the ad revenue for the entire video? It seems odd to me.

That's definitely a big issue. It doesn't respect the value the video creator brings at all. It's exactly what Ed is complaining about, just opposite of how he sees it. Someone (the labels, publishers etc.) making money off of someone else's IP (video creator).

If you are a paid presenter, you are monetizing the use of the IP. It doesn't matter, there are countless other examples where monetizing does not automatically disqualify fair use, including court cases. You just don't want to believe it and refuse to accept that you are wrong. Go ahead and put me on ignore, because I am not going to pretend to have any respect for you.

I can’t comprehend giving away music for fractions of pennies being perfectly cool but someone discussing a 10 second clip from an appreciative and theoretical POV is egregious. I’m completely reversed on that in that I’d begrudgingly put my music on Spotify while if I saw Beato made a vid about one of my songs, I’d be ecstatic it struck a chord with someone enough to put the effort into discussing it. Just having the song resonate with anyone else but me is worth a fuck load more to me than the $1 I’d get in a year or two of Spotify plays.
