You have to admit some of the double standards around this are ironic

If Gibson isn't active in protecting their trademarks, they lose the battle and it's open season on cloning their stuff. That's the way it is in the eye of the law, so they have to show that they are on top of it. Sometimes they do get a bit overzealous, but I guess they have a 'better safe than sorry' attitude.

And it should also be put out there as a reminder that if anybody could steal anything with impunity, the motivation to innovate would quickly disappear. Why work your ass off for months or years only to have somebody rip you off and then steal your market with cheap knockoffs?

Gibson only drives me wonky when (1) the legal position is hiiiiiiiiighly questionable and/or (2) the business decision to sue is even more questionable.

I'm fine with Behringturd when they are riding the line -- but the recent tipping over into "what's the thing we're making a copy of called? Yeah, let's call ours that, too." is...my guess, a stupid marketing ploy where they are banking not on the name itself to drive sales, but the drama surrounding "did you see what Behringturd did?!?" to give them more exposure than they would have gotten otherwise on releasing the product.
 
One of the few things Norlin did right was adding the volute to strengthen up the neck joint, and people lost their shit because the volute wasn't authentic to the originals...
If they had designed properly in the first place ?

Yes, they did. Sorry but you're just wrong and haven't done your homework on this, obviously.

When those plastic turds were first presented (during NAMM, iirc) the enclosures looked too much like the Boss units, which is why they had to change it before the product line hit the streets.

Moog stopped making that range back in 2018.
Prices of old ones on the used market have gone through the roof .
So I don’t see anything wrong with any company bringing it back at a affordable price so people and youngsters can get to try one 👍

Just thinking out loud here, but would you still look upon the Behringturd stuff so favorably if they were priced the same as the originals? I only brought this up because it's always bothered the shit out of me that Joyo has basically taken over Tech 21's business by flooding the market with cheap clones. And people are okay with it because it's cheap, so they keep doing it.

I don’t get being mad at somebody for supplying a thing at a lower price? How long should the “innovator” get to price things higher just because they were first to market? Is it different with guitar gear than it is with medicine? I sure as hell ain’t paying Advil prices for my ibuprofen.

There are laws that clearly define the answers. For technology, the innovator gets 20 years. For trade names and trade marks, it’s as long as they register and protect them.

The reason is exactly what you alude to. For technology, it benefits society to limit the time of protection. There is no benefit to us as consumers by allowing others to use brand and product names.

It wasn't their thing to begin with. Somebody else put in the time and effort to create it and bring it to market. Like I said, if nobody objects to the thievery then the innovators will eventually stop creating cool new stuff. I would rather spend more money to support the people creating this stuff than selfishly fuck them over so I can save money by buying the cheap ripoffs.

Laws define what’s legal. These conversations are never rooted in laws, and show that people’s feelings about what is okay and what’s not often deviate significantly from the law (which isn’t always a bad thing - but in this instance I think our laws and how people have used them have re-shaped what people think is fare/just in a bonkers, anti-consumer direction).

so generic drug manufacturers just shouldn’t be a thing and we always pay what the discoverer of the new drug wants us to?

Please explain to me how making Behring Turd use a different name on their version of the pedal is anti-consumer.

Sorry, but IP law has evolved over time but the concepts that have been steady for centuries prevail for good reason. There is no benefit to anyone but Behring Turd to allowing them to use other peoples trade names.
