Behringer Klone

Statute of limitations for a case like this in the USA is between 2-6 years. How long has Behringer’s model been on the market?
It was released back end of last year 2024.
When I said it’s been to long ,
I meant there’s been shed loads of copies released over the last decade or so.
Behringers Legal team will pull the claims to bits eventually if and when it ever gets to court??
Notice all the Behringer pedals have sold out yet again everywhere 😂🤣
Wonder if there is even a law suite and not just a big marketing exorcize between both players ???

Name one other Klone that copied the trade dress and the name? You can't protect a circuit, the other copies of the circuits are irrelevant. Names and trade dress you absolutely can protect.
 
Earlier today I was remembering the first time I saw and heard an original Klon round Jeff Becks .
He couldn’t make up his mind to use one or two on some tracks he was working on ?
I said why ask me I’m just a drummer but I do like two.👍
He then said I will get another and try three.
I know who has that third one and cherishes to this day 👌
 
Companies like Gibson have sued other guitar manufacturers for way less and won.

That’s not going to happen .
He’s left it far to long and it will cost him to much to fight in any court in the land.
It’s like Fender trying to start a legal battle with every company on the planet that builds and sells a Strat & Tele style guitar.s
You have more chance of Marvin Gayes Sister winning a case of someone copying one bar of a Marvin Gay song used on one 😳🤣😂
You don't see any of those Strat off tele copies with the word Stratocaster or telecaster on them, nor do you see them with headstocks that are the same shape as Fender's. Because...those are the things Fender has trademarks on; not the body shapes, scale length, etc.

There's no reason for a case like this to become wildly expensive. There aren't expert witnesses or anything. Given how bold Behringer has used the name and exact image it's not like Klon needs to go on a wild discovery expedition. I'm sure they'll plan to file a motion for summary judgment and short circuit trial all together with the only legit defense Behringer has is invalidity of the mark. That's not a nothing burger defense, but...it is often a matter of law ripe for summary judgement without need for a trial.

I’m not aware of any other manufacturer that copied their name and logo 1:1.
There have been loads of exact Chinese copies kits and built versions on eBay Ali express & TEMU for years ??

He added a knob because the original was a female and carried on as normal 👍🍺

That's not remotely the same. Just like Chibsons none of those are for sale in guitar center which is why neither Gibson or Bill Finnegan are issuing legal paperwork on either Chibson or the fake Klons on Aliexpress.

I haven't read the complaint, but a (very) cursory search of registered marks owned by Klon LLC shows it's literally just the names Klon and Centaur. So yeah, Behringer can get around this really easy by making changes. But..they could have, ya know, called it literally anything other than Centaur, and never gotten in this mess in the first place. So now, at best, they're going to have to pay attorneys to respond to what, on its face, is a very legitimate complaint. At worst they have to pay attorneys to respond AND pay a whole bunch of damages and/or settlement cost. On top of just doing what they obviously should have done to begin with. Because there is no way that using the name "Centaur" vs. "Shentaur" is going to give them enough additional profits to justify the cost they are going to shoulder in dealing with this.
 
Of course they're outstanding pedals. They copied an outstanding circuit. What none of the pedals in the above photo did, however, was copy exactly a registered mark.
